A complicated land claim for property in New York City, buyers Michael Grosz and Frederick H. Grosz purchased the property at a foreclosure sale based on an order of the Supreme Court of the State of New York. After the purchase and before taking possession the Gosz' became aware of several covenants and prior agreements associated with the property which they alleged were not disclosed before the sale and which would have prevented them from using the property as they desired. They refused to complete the purchase. Both Riggs and Pursell had an interest in the property and sought to enforce the sale.
